MINUTES OF THE NEW UNDERWOOD CITY COUNCIL


A regular meeting of the New Underwood City Council was held at 6:00 p.m. at City Hall on April 6, 2021. Present were: Mayor Teresa Hall, Council members: Larry Graham, Tara Richter, Tera Hockenbary and Kathy Trullinger. Also present: Meri Jo Anderson, Finance Director, Kristi Pritzkau, Finance Officer, Director of Public Works Tim Hall, Deputy Jones, Sgt. Harkins, Tyler Richter, Dale Boydston and Gene Patrick. The meeting was called to order by Mayor Hall with the Pledge of Allegiance following.

PUBLIC HEARING

A public hearing was held for Special License #21-05 for the Corner Bar at the Rodeo Grounds on May 31st, SL #21-06 June 14th and 20th, SL# 21-07 July 5th and 19th, and SL #21-08 August 9th and August 23rd, 2021 for barrel racing. No one presented themselves to voice any objections. Mayor Hall closed the hearing at 6:03 p.m.

MINUTES

Moved by Hockenbary second by K. Trullinger to approve the minutes for March 16, 2021. Aye: all. Nay: none. Motion carried.

The vouchers, bill-list, savings sheet, monthly revenues and savings sheets were presented. Motion by Hockenbary seconded by Richter to approve the financial reports and the following warrants. Aye: all. Nay: none. Motion carried.

DIRECTOR OF PUBLIC WORKS

SDARWS plans to be available to help with the hydrants that need repairs next week.
Mr. Hall has found a truck driver that would haul the white goods at the dump out and haul gravel back in order save on the trucking cost. The Council all agreed Mr. Hall doesn’t have to get prior approval for regular maintenance, such as hauling gravel for parking lots, as that has been budgeted for.
CECILIA LANE

The two manholes for Cecilia Lane have been poured and should be delivered next week. R&R Trenching will then be complete the sewer line there.
MAYOR

Blake Fastnacht is available to bale the tires that are left during clean up weekend during the first weekend of May. The cost last year was $660.00.
Mayor Hall has been in contact with the owners of the trailer house without skirting at the Boondocks campground and they plan to move it out of town soon.
Mayor Hall is working on getting the unofficial Facebook page activated.
The list of SDML meetings includes the HR and FO school in Pierre on June 8th through the 10th, 2021. Former Mayor Trullinger has said he will cover the office for those dates as Mrs. Rankin will not be available.
The District Meeting will be hosted in New Underwood next year as we were not able to meet in person last year or this year.
LAW ENFORCEMENT

Deputy Jones presented the monthly report. He also stated the Animal Control will begin making patrols around town soon and any dogs that are found loose will be hauled in and a County citation will be issued.



BUILDING PERMITS

Motion by Graham second by Hockenbary to approve Building Permit #21-08 for Colin and Sara Hansen at 207 E. Oak St. for a 50’ x 72’ shop pending payment, Building Permit #21-09 for the Bridled for Christ Church at 16104 Hwy 1416 for a 30’ x 48’ addition to the church building as both buildings will meet setback requirements and Building Permit #21-10 for Jeanette Wallace at 501 S. B Ave. to remove the sidewalk on the west side of her house. Aye: all. Nay: none. Motion carried.



BOYDSTON HEIGHTS PLAT AND PETITION FOR ANNEXATION

With Pennington County Planning and Zoning having approved a visual inspection of the replat of the land belonging to the Estate of Charles Boydston the Council agreed that it meets all requirements.

RESOLUTION NUMBER 21-01



WHEREAS a plat of, Being Tract A of Boydston Heights Subdivision Located in the W ½ NW ¼ of Section 29, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota was submitted for the purpose of examination and approval by the governing body, and



WHEREAS it appears that said plat conforms with the system of streets and alleys of the existing plat of said City and additions thereto, and that all municipal taxes and special assessments have been fully paid and that the plat of said lots had been executed according to law, and



NOW THEREFORE BE IT RESOLVED that the plat of, Being Tract A of Boydston Heights Subdivision Located in the W ½ NW ¼ of Section 29, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota be and the same is hereby approved and the Finance Officer of New Underwood is hereby authorized to endorse on such plat a copy of the resolution and certify as to its correctness.

RESOLUTION NUMBER 21-02



A RESOLUTION EXTENDING THE BOUNDARIES OF THE CITY OF NEW UNDERWOOD, SOUTH DAKOTA, BY ANNEXING LANDS MORE SPECIFICALLY DESCRIBED HEREIN.



WHEREAS, not less than three-fourths of the registered voters and the owners of not less than three-fourths of the value of the territory sought to be annexed have petitioned the Common Council of the City of New Underwood for concurrent annexation and rezoning of the territory herein described; and,



WHEREAS, the territory described herein adjoins and is contiguous to the existing boundaries of the City of New Underwood and is not separated from the existing City by any significant physical barriers, and annexation is natural and reasonable and the municipal body hereby created constitutes a homogenous and unified entity.



WHEREAS, the Common Council for the City of New Underwood desires to annex this property to expand its borders and growth control, and



NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of New Underwood, Pennington, South Dakota, that the following described territory and the same is hereby annexed to the City of New Underwood, to-wit: (See Exhibit A, attached to this resolution); Tract A of Boydston Heights Subdivision located in the W ½ NW ¼ of Section 29, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota

ANNEXATION

Dale Boydston inquired about annexing the land to the north of the property just approved for annexation and the land east of the Cemetery. Discussion included the water availability, requiring of 6” water mains, no impact fee if annexed, only a tap fee, use of septic systems where needed, dedicated right of ways, lot sizes, possibly some multi-family homes, no mobile homes allowed, 17 acres of green area through the land east of the Cemetery, donating approximately 1 acre to the New Underwood Cemetery and much more. The Mayor and Council asked Mr. Boydston to fill out a petition for annexation for the property that he would like to annex and turn it into City Hall. He will be placed on the Agenda for the next meeting on April 20, 2021.



EMPLOYEE HANDBOOK UPDATE

Motion by Hockenbary second by Richter to approve and update to the Employee Handbook Payroll Period Policy to say the payroll period begins on Friday at 12 a.m. and ends the following Thursday at 11:59 p.m. Aye: all. Nay: none. Motion carried.



MOBILE LIBRARY

The Rapid City Library plans to have a mobile library in the parking lot of the Community Center on every other Monday starting on May 3, 2021. Motion by K. Trullinger second by Hockenbary to allow them to park on any City property if the Community Center happens to be rented on one of the days the mobile library plans to be there. Aye: all. Nay: none. Motion carried.



OTHER ITEMS DISCUSSED:

The Sami Jo Memorial Pool Manager Jaedyn Finkbeiner will come home this month to check in on the pool and give an opening date based on any necessary maintenance.
The Mayor asked the Council to let her know if they could think of any projects for the school students to do on Pride Day around town.
The Mayor had someone report to her that a calf was being kept in a yard that is not zoned Ag. A letter will be sent to inform them this is not allowed by City Ordinance.


Being no further business Mayor Hall adjourned the meeting at 6:49 p.m.
