MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on July 3, 2013. Present were: Mayor Jack Trullinger, Council member’s: Rikka Buchtel, Laurie Holloway, Kathy Trullinger, and Joe Whitney. Also present: Finance Officer Meri Jo Anderson, Dir. of Public Works John Bale, Deputy McPherson, Dianne Trullinger, and Cris Anderson. The meeting was called to order by Mayor Trullinger.

Motion by Buchtel second by Whitney to approve the amended agenda. Aye: all. Motion carried.
MINUTES
Moved by Holloway second by K. Trullinger to approve the June 19, 2013 minutes as presented. Aye: all. Motion carried.
FINANCIAL REPORT & BILL LIST
The financial reports, bill-list and vouchers were presented. Motion by Buchtel second by Whitney to approve the financial reports and the following warrants as presented. Aye: all. Motion carried.

PUBLIC WORKS
Mr. Bale reported he had sprayed for mosquitoes, the flood ditches are mowed, and water break repaired. Council expressed appreciation from the citizens on the mowing.
LAW ENFORCEMENT
Deputy McPherson presented his written monthly report.
AQUATIC DIRECTOR
A new chlorinator was purchased. Adult swim starts this month 6:30 to 8:00 pm. The need to move a camera to the west.
MOTOR HOME ORDINANCE
Ordinance Number 13-05 received its first reading. (This ordinance sets regulations for storage and parking of recreational vehicles.) Motion by K. Trullinger second by Buchtel to approve the first reading of Ordinance Number 13-05. Aye: all. Motion carried.
VOLUNTEER
Ruth Ekern volunteers to plant and water the flowers at the park and city hall. This is done at no expense to the city. Motion by Buchtel second by Holloway to appoint Ruth Ekern as a city volunteer. Aye: all. Motion carried.
RESOLUTION NUMBER 13-11
WHEREAS a plat of Lot A and Lot B of Brandsted Subdivision Section 30, R2N R11E BHM New Underwood, Pennington County, South Dakota, (formerly lot 1 of the SE ¼ SE ¼ of Section 30, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota, was submitted for the purpose of examination and approval by the governing body, and
WHEREAS it appears that said plat conforms with the system of streets and alleys of the existing plat of said City and additions thereto, and that all municipal taxes and special assessments have been fully paid and that the plat of said lots had been executed according to law, and
NOW THEREFORE BE IT RESOLVED that the plat of Lot A and Lot B of Brandsted Subdivision Section 30, R2N R11E BHM New Underwood, Pennington County, South Dakota, be and the same is hereby approved and the Finance Officer of New Underwood is hereby authorized to endorse on such plat a copy of the resolution and certify as to its correctness.

OPEN CONTAINER
A request from Moes and the Hall to the Council about holding a street dance on July 27, blocking off “A” Ave between Pine and Oak with open container allowed in this area. The same restrictions will be adhered to as in previous years that there is access for emergency vehicles and residents who live in this area, allowing for open container, and wrist bands are used. Also requested was open container at the rodeo grounds on August 17, 2013. Moved by Buchtel second by Whitney to approve these requests. Aye: all. Motion carried.
The special license for August 17 will be placed on the agenda for July 17.
BLOCK PARTY AT PARK
Hills of Grace Fellowship/Paradigm Church requested holding a block part at the park July 24 from 11-2 p.m., which will include bouncy toys, BBQ, games ect. (Their proof of insurance is on file at city hall.) Motion by Buchtel second by Whitney to approve this request. Aye: all. Motion carried. The Council stated they did not want the event on the street.
HOME RULE
Home rule is a form of government that is currently used by at least ten communities within the state, this form of government allows cities to govern as best fits their community’s needs, as long as state law does not expressly forbid it.
Resolution Number 13-12 was introduced.
RESOLUTION NUMBER 13-12
WHEREAS the New Underwood City Council sees that local government can be streamlined by the implementation of the home rule form of government, and
WHEREAS the state constitution provides that any city may provide for the adoption of a home rule charter, and
WHEREAS the state constitution’s rules for establishment of a home rule charter are quite cumbersome and should be changed to provide for statutory home rule for local governments, and
NOW THEREFORE BE IT RESOLVED by the New Underwood City Council that the Legislature of the State of South Dakota be encouraged to provide for statutory home rule for local governments, and continue to outline, within this law, the standards that are to be met and the powers that are not included expressly.

Other items discussed:
1. Three of the Council will attend the elected officials workshop in Pierre July 24, 2013.
2. The tires from clean-up day have been hauled to the Rapid City Landfill, the cost was $348.50 and five trips to Rapid City.
Being no further business Mayor Trullinger adjourned the meeting at 6:40 p.m.
