Minutes of March 21, 2012





A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on March 21, 2012.  Present were: Mayor Jack Trullinger, Council member’s: Rikka Buchtel, Bob Hall, Laurie Holloway and Joe Whitney. Also present: Finance Officer Meri Jo Anderson, Dir. Of Public Works John Bale, Cris Allen, Jim  & Kathy Harbert, Dianne Trullinger, Deputy McPherson, Sheila White, Ronnie Racicky, Jessie Willis and Dale Boydston. The meeting was called to order by Mayor Trullinger.



Motion by Buchtel second by Whitney to approve the amended agenda.  Aye: all. Motion carried.



Moved by Buchtel second by Hall to approve the March 7, 2012 minutes and the March 19, 2012 equalization minutes as presented.  Aye: all.  Motion carried. 



Pump went out again at the lift station, plugged with towels and rubber gloves.  The new stand-by pump was installed and a new pump or reconstructed pump must be purchased.  Motion by Whitney second by Hall that the City purchase the reconditioned pump or new pump.  Aye: all.  Motion carried.



Supplemental Budget Ordinance number 12-04 was introduced.  This adds money to the budget for the lift station pump.  Motion by Buchtel second by Holloway to accept the first reading of ordinance number 12-04.  Aye: all.  Motion carried.



Mr. Bale reported the backhoe is in for repairs and he has a loaner.  Motion by Whitney second by Buchtel to authorize Mr. Bale additional monies to get these repairs.  Aye: all.  Motion carried. Finance Officer advised Council to put a lease purchase for new backhoe and bobcat in the 2013 budget.



Mayor Trullinger attended the county meeting for rewriting the mitigation plan.  The plan has to be updated every 5 years.  Every municipality in the county is eligible to benefit from the grants made available.  He will continue to update the city on these meetings.



Due to citizens allowing their dogs to run at large, which is against city ordinance, the City will start trapping dogs next week.  If the dog can be identified from his city tag the owner will be contacted the first time to pay the $25.00 fee and the dog will be released to their custody.  If no tags are on the dog and it cannot be determined who the owner is, the dog will be taken to the animal shelter immediately.  The second offense the dogs will be taken to the animal shelter, and no owners contacted.

A dog owner has been given 10 days to abate the nuisance of his barking dog. The owner stated he will take care of the problem.


April 21 & 22 will be clean up week-end.  Notices are up around the city.  Motion by Buchtel second by Whitney to allow 4 tires per household in the city limits to dump  tires at the dump that week-end.  Aye: all.  Motion carried.



Ordinance Number 12-03 received its second reading.




BE IT ORDAINED by the Common Council for the City of New Underwood that Article II; General; Sections III & IV be amended into the existing ordinances:

1.         Officers.

The civil officers of the City shall be the Finance Officer, Attorney and the chief of police (if not Pennington County Sheriff Contract).  The Director of Public Works, Aquatic Director and City Engineer are other officers that are also appointed by the Mayor and approved by the Council for the necessary administration and affairs of city business. 

2.         Oath of Officer.

Each civil officer and such other officers as may be is required to shall take an oath of office before entering upon the discharge of duties. 


1.         The Mayor and Alderman shall have two regular meetings per month which will be on the first and third Wednesdays of the month.  The meetings shall be open to the public. and held at the City Hall. Amended by Ordinance #92-2

2.         The mayor and Alderman shall meet the third Monday of March, as per SDCL, for the purpose of equalizing the assessment of property.  The Equalization Board may adjourn from day to day until the process is completed, but must be completed within five days.

Motion by Buchtel second by Whitney to approve the second reading of Ordinance Number 12-03.  Roll call vote.  Aye: Buchtel, Hall, Holloway, and Whitney.  Motion carried.



Discussion on flooring for community center followed.  Retiling with the same type of tile is $4,273.28 for entry, kitchen, and big room.  The school will be waxing the floor the last week of May.  Due to the floating floor and the ground shifting and cracking tiles, it was moved by Buchtel second by Hall to contact the city engineer for possible realistic solutions to fix the floor. Aye: all.  Motion carried.


Dale Boydston is interested in purchasing the ground storage tank.  He also offered to purchase the building it is in for $1,000.00. The Council agreed they are not interested in surplusing the building, since they plan on using it for cold storage. Discussion followed about putting a 14 or 16 foot door  on the west side of the building. Motion by Whitney second by Buchtel to take off the stipulation on the $500.00 tank purchase that the building must be put back to the condition it was in prior to tank removal.  Aye: all.  Motion carried.



The Mayor is continuing to work with the Swanson’s about getting a utility easement to run across their property and the proposed route has been marked. In the meantime a utility easement in right of way along 161st street has been obtained.  Pennington County Highway is paying for all materials and the boring.



A resignation was received from Ward 2 Councilor Bob Hall, who has to step down due to financial reasons.  Motion by Buchtel second by Holloway to accept this resignation. The Mayor, Council, and attendees, thanked him for his service.

Motion by Whitney second by Buchtel to appoint Sheila White to fill this vacancy until her unopposed appointment in May.  Aye: all.  Motion carried.



The 2011 drinking water report was presented and copies are available at city hall and on line at The Mayor congratulated public works on a good report.



Fire Chief Racicky and Jessie Willis showed the Council how the jaws of life works.  The jaws of life (approximate value $16,000.00) were a gift from the Box Elder Fire Department.  The City will send a letter of appreciation to the Box Elder Fire Board and the Box Elder Fire Department.

Motion by Buchtel second by Whitney to approve this permit.  Aye: all.  Motion carried.


Other items discussed:

  1. Governmental      Funds sheets were presented by the Finance Officer.
  2. Tires      were left behind the shop, public works paid to get rid of them.
  3. Hydraulic      hose on grader replaced.
  4. McWrench      is fixing brakes on the blue dump truck.       Thanks to Councilman Whitney for locating the problem with the      truck, and he will teach public works how to adjust the brakes. 
  5. Election      will be April 10, 2012.
  6. Pet      clinic April 29th.
  7. District      9 Edgemont meeting April 19, 2012. Councilors Buchtel, Whitney, White, Mayor      Trullinger, and Meri Jo will attend.

Being no further business Mayor Trullinger adjourned the meeting at 7:00 p.m.
