MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held on June 14, 2004 at 6:00 p.m. Present were: Mayor Benita White, Councilmembers: Jackie Dahlquist, Michael Green, Tyler Richter and LeeAnn Schumacher. Also present: The Fin. Officer Meri Jo Anderson, Dir. of Pub. Works Greg Hall, and Asst. Finance Officer Teresa Gossard.
AGENDA
Motion by Schumacher second by Richter to approve the amended agenda. Aye: all. Motion carried.
MINUTES
Motion by Dahlquist second by Richter to approve the June 2 and June 10, 2004 minutes. Aye: all. Motion carried. (On the June 2 meeting the entire cable TV franchise agreement was not published, so we could get an audit exception, but it saves us from $500.00 to $1,000.00.)
FINANCIAL STATEMENTS
The governmental funds sheets to date were presented to the Council.
FLOOD DITCH
The flood ditch will be mowed the week of June 22, so it will be ready for the 4th of July.
COMMUNITY CENTER
The attorney determined a breach of contract on the roofing job, this breach occurred due to the time requirements and the wrong gauge of steel. To resolve this matter expeditiously and without further detriment to the community, the Council authorized the attorney to settle the matter by getting the $4,250.00 advance back and the contractor agreement to terminate the contract. The contractor has met these requests and the roofing job will proceed anew.
Discussion on removing shingles and the City purchasing the materials themselves was held. Moved by Dahlquist second by Richter to negotiate with the contractor who had the next lowest quote. Aye: all. Motion carried. Motion by Richter second by Schumacher to replace the rain gutters on the west and east side of the center with metal gutters. Aye: all. Motion carried.
Steve Street has been contacted on the swamp coolers, they are fifteen years old, and one has the motor out and both are rusted out. For now floor fans will be purchased.
FIREWORKS
The Council agreed the ordinance would remain in effect this year with fireworks only being shot off on the Fourth of July, and may be purchased June 27 through July 5.

Resolution Number 04-04 was introduced.

BE IT RESOLVED by the New Underwood City Council that the following property be declared surplus to be sold: Office Supplies, Shop supplies, tools, Police equipment, and other miscellaneous items.

Moved by Schumacher second by Dahlquist to approve this availability requests pending payment. Aye: all. Motion carried.
BUILDING PERMITS
#04-20; Best Little Store House; 300 S. "A" Ave.; Addition and variance on set backs to the west.
04-21; Dave Dietrich; 102 S. Monroe; cement pad.
The Council went and physically looked at where the addition to the storage shed would sit. After a lengthy discussion it was moved by Schumacher second by Richter to table this permit until the next meeting. Aye: Dahlquist, Richter, and Schumacher. Abstain: Green. Motion carried.
Moved by Richter second by Dahlquist to approve permit 04-21. Aye: all. Motion carried.
BUILDING CODES
Discussion on the need for stricter building codes than State Law followed. If we implemented stricter building codes we would need to hire a building inspector to enforce these codes.
APPOINTED OFFICIALS
An ordinance on appointed officials will be prepared for the next meeting.

SOUTH DAKOTA RETIREMENT SYSTEM
SPECIAL PAY PROGRAM UNIT
BE IT RESOLVED AS FOLLOWS:
WHEREAS House Bill 1033 of the 2004 Legislative Session offers qualified members of special pay program units of the South Dakota Retirement System (SDRS) the opportunity after July 1, 2004, of receiving a tax advantage and a Social Security advantage when terminating active service in SDRS by having speial termination payments transmitted to the Special Pay Program;
WHEREAS House Bill 1033 offers such qualified members’ employers a corresponding Social Security advantage;
WHEREAS, the City of New Underwood wishes to off this option to its qualified permanent, full-time employees, all of whom are members of SDRS;
WHEREAS, the City of New Underwood agrees to transmit all special pay data by electronic media and understands that reporting final compensation data electronically is a condition which must be met in order to participate;
WHEREAS, the City of New Underwood understands and agrees to the following points: Only special, lump-sum payments made to an employee at the time of the employee’s termination are transmitted to the special pay program; only employees age 55 or older qualify to have such special pay transmitted to the special pay program; only such special payments of $2,000.00 or more qualify to be transmitted to the special pay program; If the employee qualifies and the special pay qualifies, transmission of such special pay to the special pay program is mandatory; and the City of New Underwood shall pay to SDRS an initial, one-time fee per participant of .75% of such special pay or $45.00, whichever is greater.
NOW, THEREFORE, BE IT RESOLVED, that the City of New Underwood shall become a special pay program unit of the South Dakota Retirement System under the terms and conditions of House Bill 1033 of the 2004 Legislative Session with an effective date of August 1, 2004.

OTHER ITEMS DISCUSSED
- When the weather gets warmer the public works staff will begin hot mixing. They will begin laying the water main to the west when it is delivered.
- The City Engineer will meet with us on June 23rd at 1:00 p.m. on the feasibility study on rural water development.
- Trench Box is here.
- South end of ditch in alley between "A" & "B" Ave needs repaired. Ditch west of Janklow Ave. needs mowed.
- No answer on the Rodeo Grounds key.
- A letter will be written to a business owner on garbage blowing out.
- It is highly unlikely an animal could get through the lift station and into the system.
Being no further business, the Mayor adjourned the meeting at 8:46 p.m.
