MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL


A regular meeting of the New Underwood City Council was held at 6:00 p.m. at the Community Center on May 1, 2019. Present were: Mayor Jack Trullinger Councilmembers: Teresa Gossard, Larry Graham, Karin Shoemaker, and Kathy Trullinger. Also present: Meri Jo Anderson, Finance Director, Kristi Pritzkau, Finance Officer, Sergeant Harkins, Melanie Tish, Josie Tish, Ava Krebsbach, Caleb Hodo and Serena Rice. The meeting was called to order by Mayor Trullinger with the Pledge of Allegiance following.

Motion by Gossard second by Shoemaker to approve the agenda. Aye: all. Motion carried.



MINUTES

Moved by K. Trullinger second by Graham to approve the April 17, 2019 minutes as presented. Aye: all. Motion carried.



FINANCIAL REPORT & BILL LIST

The financial reports, bill-list, savings sheets and vouchers were presented. Moved by Graham second by Shoemaker to approve the financial reports and the following warrants as presented. Aye: all. Motion carried.

Motion by Gossard to transfer $49,960 from the roof insurance fund to the water fund to cover the cost of the new water meters. Aye: all. Motion carried.



LAW ENFORCEMENT

Sergeant Harkins presented the written monthly report. There were a total of 174.5 City hours last month.



MAYOR

The City of New Underwood and the Director of Public Works received a certificate for safe water from the SD DENR.

A letter was sent to a resident regarding loose garbage in their yard.

The pet clinic on April 13th had approximately 20 vaccinations and there were 8 City pet licenses purchased.

A SD Retirement System Board of Trustees position will soon be vacant. Mayor Trullinger stated that elected officials resumes can be turned in to the SDRS Executive Director for the 2019-2021 term for the position.



ORDINANCE # 19-04

Ordinance # 19-04 removal of the obsolete penalty section of Article III; A. Utility Ordinance #1. Water; Section 14 received its second reading.

AN ORDINANCE TO AMEND ARTICLE III - UTILITIES; A. UTILITY ORDINANCE #1- WATER – SECTION 14,



BE IT ORDAINED by the Common Council for the City of New Underwood that Article III – Utilities A. Utility Ordinance #1 Water - Section 14 be deleted and all subsequent sections be renumbered accordingly. (Strikeouts are deletions.) SECTION 14. PENALTY CLAUSE. Any person failing or refusing to follow the rules and regulations relating to this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined $100.00.

Motion by Gossard second by Graham to approve this Ordinance. Roll call vote. Aye: Gossard, Graham, Shoemaker and K. Trullinger. Nay: None. Motion carried.



MALT BEVERAGE LICENSE RENEWALs

Motion by Gossard second by Graham to approve the renewal of the Corner Bar; Serena Rice and Wendy Philipsen at 524 S. A Ave. Uniform Alcoholic Beverage License; Malt Beverage and SD Farm Wine License. Aye: all. Motion carried.

At the April 17, 2019 meeting is was moved by Graham second by K. Trullinger to approve the renewal of Harry’s Hideaway; Harold Jensen at 16092 Highway 1416 and The Hall; Tim Hall at 412 S. A Ave.; Uniform Alcoholic Beverage License; Malt Beverage and SD Farm Wine Licenses.



BUILDING PERMIT #19-04

Mayor Trullinger recommended approval of BP # 19-04 pending the resident move the fence to within the setbacks within 30 days with the stipulation that if it is not moved within that time frame a $100.00 fine be imposed. Motion by K. Trullinger to approve this recommendation second by Gossard. Aye: Gossard, Shoemaker and K. Trullinger. Nay: Graham. (He had spoken to the resident and they understood the fence needs to be moved soon) Motion carried.



BUILDING PERMIT #19-05

Motion by Gossard second by K. Trullinger to approve Building Permit #19-05; Fence at 403 S. B Ave. as it meets all setbacks. Aye: all. Motion carried.



APPRAISAL BOARD

It was moved by Gossard seconded by K Trullinger to appoint the City Council as the Appraisal Board for the year 2019. Aye: all. Motion carried. The Appraisal Board went into session at 6:35 and discussed the option of pricing per dumpster or all as a group. It was decided that it would be in the City’s best interest to price them at $4,100.00 as a whole. They closed the appraisal board meeting at 6:45 and reconvened the City Council meeting.



SURPLUS METAL DUMPSTERS

Motion by Gossard second by K. Trullinger to advertise all 82 metal dumpsters for $4,100.00 for 2 weeks. Sealed bids will be accepted at City Hall. Aye: all. Motion carried.



OATHS OF OFFICE

Mayor Trullinger administered the Oath of Office to Councilors Graham and K. Trullinger.



COUNCIL PRESIDENT & VICE PRESIDENT

The Mayor read the duties of the Council President and Vice President. Motion by Gossard second by Shoemaker to appoint Councilor Graham as Council President. Aye: all. Motion carried. Gossard nominated K. Trullinger as Vice President. K. Trullinger nominated Shoemaker

as Vice President. Shoemaker nominated Gossard as Vice President. Motion by Graham second by Gossard to cease all nominations. The Council voted and Shoemaker was chosen Council Vice President.



APPOINTMENTS

The Mayor made the following recommendations for appointments & designations: Finance Director – Meri Jo Anderson; Finance Officer – Kristi Pritzkau; Director of Public Works – Timothy Hall; City Attorney – Terry Westergaard; Law Enforcement – Contract Pennington County. Motion by Gossard second by K. Trullinger to approve these appointments. Aye: all. Motion carried. Mayor Trullinger administered the oath of office to Meri Jo Anderson and Kristi Pritzkau. The City Attorney will take his oath at the next meeting.



LEGAL NEWSPAPER

The Mayor recommended appointing the Pennington County Courant as the legal newspaper (Reference: SDCL 9-12-6). Motion by Gossard second by K. Trullinger to approve this recommendation. Aye: all. Nay: none. Motion carried.



OFFICIAL DEPOSITORY

The Mayor recommended designating First Interstate Bank and SD Public Funds Investment Trust as the official depositories of City funds. Motion by K. Trullinger second by Gossard to approve this designation. Aye: all. Nay: none. Motion carried.



OTHER ITEMS DISCUSSED:

The C.O.R.E. (freshman impact) program is May 9, 2019.
Kindergarten Celebration is May 8th.






Being no further business Mayor Trullinger adjourned the meeting at 6:58 p.m.
