MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A public hearing on the 2013 Budget was opened at 5:30 p.m. on August 1, 2012. Present for the hearing was Mayor Trullinger, Councilors Buchtel, White, and Whitney, Meri Jo Anderson, and Cris Allen. The Mayor went over the budget section by section, and from the input received, the changes to the budget will be made.
A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on August 1, 2012. Present were: Council member’s: Rikka Buchtel, Laurie Holloway, Sheila White, and Joe Whitney. Also present: Finance Officer Meri Jo Anderson, PW Chris Beesley, Cris Allen, Dep. McPherson, Dianne Trullinger, Phil & Deanna Bray, Rory Pischer, Jon & Irene Madsen, Dean Hackens, and Jim McKee. The meeting was called to order by Mayor Trullinger.

Mr. Beesley reported the staff has been mowing, community center repairs, finished south water main, and patching streets. Door for the ground storage building is in.

SAMI JO POOL
The aquatic director reported session three swim lessons this week.
Adult swim is Tuesdays and Thursdays from 6:30 – 8:00 p.m.
ORDINANCE NUMBER 12-09
The Mayor called the city attorney during the meeting and via conference call he answered concerns with the penalty clause ordinance. The necessary changes were incorporated into Ordinance Number 12-09 and it received its second reading.
ARTICLE 1 ORDINANCE PENALTY MODIFICATION
STANDARD MUNICIPAL PENALTY CLAUSE
APPLICABLE TO ALL CITY ORDINANCES AND TO THOSE RESOLUTIONS WHICH HAVE BEEN SPECIFICALLY DESIGNATED TO APPLY.
BE IT ORDAINED: By the City of New Underwood, Pennington County, South Dakota, as follows:
All penalty clauses on all existing Ordinance in and for the City of New Underwood shall be declared amended to read as follows: Violation of any City Ordinance shall be a minimum of a $100.00 fine and a maximum fine not to exceed $200.00, and/or 30 days in jail. A minimum of at least 72 hours must lapse before another citation for the same offense is issued. This penalty clause shall apply to all articles, sections, or parts thereof of the compiled City of New Underwood Ordinances.

CITY of NEW UNDERWOOD
AUTHORIZING RESOLUTION
ESTABLISHING AN INCIDENTAL ACCOUNT
WHEREAS, the State of South Dakota has authorized the establishment of an incidental account making general fund monies available for use during the month, prior to approval at the first meeting of the month (reference SDCL 9-23-23), and
WHEREAS these funds may be expended with the signatures of two officers of the municipality, and
WHEREAS, this account is established to use when circumstances present themselves that would cause expending monies for late fees, and/or would help facilitate the flow of city business, and/or where immediate payment is required (ie internet purchases), and
WHEREAS a detailed account of the expenditures from the incidental account shall be presented with verified vouchers, itemized and supported by receipted bills or other information as evidence of payment, and shall not to exceed $5,000.00, and
NOW THEREFORE BE IT RESOLVED that the Common Council in and for the City of New Underwood does hereby establish an incidental account per SDCL 9-23-23, using the above mentioned constraints.

LABOR DAY CELEBRATION
Ron Racicky requested the use of the Community Center for September 3 for the Labor Day steam burger feed; back yard of City Hall for horseshoes; and to close “A” Ave from Pine to Elm from 10 a.m. to 6:00 p.m., and on Labor Day to allow open container from Oak to Elm and the horse pits in the back yard at City Hall. Motion by Holloway second by Whitney to grant these requests. Aye: all. Motion carried.
MEETING CHANGE
Councilor Buchtel is taking a class on Wednesdays this semester, so asked if the city meetings could be moved. After discussion, the Council decided that the meetings would be held at 7:30 p.m. instead of 6:00 p.m. until the end of the semester.
TREE OBSTRUCTION
A complaint was received by Councilor Buchtel about the trees at the corner of Oak and Madison that are obstructing the sidewalk and the intersection view. The Council did not want to burden the property owner with cutting down the trees, but said they need to be trimmed back. The Mayor will send a letter instructing the property owner to trim the trees as per city ordinance.

ABATEMENTS
A couple of the citizens in attendance questioned the Mayor and Council about the missing skirting, siding, unsecured and vacant mobile home, and dormant vehicles in the mobile home parks that are not in compliance with city ordinance. The Mayor and Council agreed that the legal channels take time, but citations will continue to be served.
Other items discussed:
1. Councilors Buchtel and Holloway and Mayor Trullinger attended the elected officials workshop in Pierre. They reported that they again learned a lot about municipal government.
2. Letters of support for the park can be signed at City Hall.
3. Rory Pischer reported on his progress to meet the 30 day extension the Council had granted on getting his mobile home into compliance with city ordinance.
Being no further business Mayor Trullinger adjourned the meeting at 6:50 p.m.
