MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held at 6:00 p.m. at the Community Center on February 20, 2019. Present were: Mayor Jack Trullinger, Councilmembers: Teresa Gossard, Larry Graham, Karin Shoemaker, and Kathy Trullinger. Also present: Meri Jo Anderson, Finance Director, Kristi Pritzkau, Finance Officer, Dir. of Public Works Tim Hall, Sara Hansen, Rick McPherson, Ava Krebsbach and Marvin Rask. The meeting was called to order by Mayor Trullinger.
AGENDA
Motion by Graham second by K. Trullinger to approve the agenda. Aye: all. Motion carried.
MINUTES
Moved by K. Trullinger second by Shoemaker to approve the February 6, 2019 minutes as presented. Aye: all. Motion carried. Ordinances 19-01 and 19-02 were inadvertently not published, and will be published with this meetings minutes.
PUBLIC WORKS
The concrete bases that the tank in the storage building on North C Ave. sat on will have to be jackhammered out.
They have been busy with snow removal.
Mr. Hall is still researching options for a plow for the pickup.
MAYOR
Applications are available for the 2019 Paint South Dakota Campaign at the South Dakota Housing Development Authority website under Social Programs.
Mayor Trullinger, Teresa Gossard, Larry Graham and Kristi Pritzkau met with Dustin Willet from Pennington County Emergency Management concerning our pre-disaster mitigation plan. Weather radio’s will be purchased for the Community Center and City Hall and a generator for the Community Center will be researched.
C.O.R.E.
Rick McPherson requested volunteers and a donation for C.O.R.E. (freshman impact) program. The local program will be on May 8, 2019. Some of the Council volunteered to help. Moved by Graham, second by Gossard to donate $200.00. Aye: all. Motion carried.
DONATION
Sara Hansen requested a donation for post prom. Motion by Graham second by Gossard to approve a donation to New Underwood School Post Prom in the amount of $100.00. Aye: all. Motion carried.
SAMI JO POOL DONATION REQUEST
The letter that has been sent yearly with an amount needed to be raised in order for the pool to continue to be free for the people using it was discussed. It was decided that as costs have increased over time it is more important to communicate the increased need than to focus on a set dollar amount. The Council feels the pool is a great asset to the community.
523 S. A AVE.
A letter of abatement was received from Pennington County for a refund of 2/12 of the property taxes paid for the structure that was located at 523 S. A Ave. and which was torn down in November. Motion by Gossard second by Shoemaker to authorize the signature of the Finance Officer on this abatement. Aye: Gossard, Shoemaker and K. Trullinger. Nay: Graham. Motion carried.
SPECIAL LICENSE
Motion by Gossard second by Shoemaker to approve SL#-19-04; Moe’s Bar and Grill; Rodeo Club Smoker; March 15, 2019. Aye: all. Motion carried.

AMENDMENT TO ARTICLE III SECTIONS 8 & 10
Article III WATER SECTION 10. Any property owner of a residence or commercial building in the City of New Underwood who is renting property or allowing said property it to be used without financial gains will hereafter, and henceforth, be responsible for utility deposit and for any utility fees which have not been paid by the person(s) residing in it on said property. i.e. Water, Sewer, Garbage
(a) It shall be the responsibility of the owner of the residence or commercial building rental property on the City of New Underwood water system to inform the Finance Officer when the property it becomes vacated, to make arrangements for the water to be either left on or turned off. If notice is not given and the City determines that the house/property residence or commercial building is vacant, the City will discontinue service and not be held responsible for any damage to the water heater or other property resulting from this action. If the owner wishes the water to be left on between renters, or when they are gone for extended periods of time, a meter deposit in the name of the owner must be on account with the City and can be classified as on vacation with no minimum water and sewer rate for that time being due. The renter shall be made aware that they must come to City Hall to establish an account.

AMENDMENT TO ARTICLE II SECTION V
Sec. 4-9. On-sale and off-sale service restricted and consumption restricted.
No On-sale or and off-sale licensee, licensed under SDCL §35-4-2, (4), (6), (11), or (13), may sell, serve, or allow to be consumed on the premises covered by the license, alcoholic beverages, between the hours of 2:00 a.m. and 7:00 a.m. including Sundays, Christmas Day and Memorial day ., or at any time on Christmas Day. Such licensees are permitted to sell, serve, or allow to be consumed alcoholic beverages on Sunday and on Memorial Day, except between the hours of 2:00 a.m. and 7:00 a.m. A violation of this section will be a Class 2 misdemeanor.

Governmental fund sheets were presented.
The furnace at City Hall was repaired by Action Mechanical and all work done was very prompt and professional.
Mayor Trullinger complimented Public Works on the good job with the snow removal.
Being no further business Mayor Trullinger adjourned the meeting at 6:31 P.M.
