MINUTES OF THE NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held at 6:00 p.m. at the Community Center on September 7, 2021. Present were: Mayor Teresa Hall, Council members: Larry Graham, Tera Hockenbary and Kathy Trullinger. Telephonically: Tara Richter. Also present: Meri Jo Anderson, Finance Director, Kristi Pritzkau, Finance Officer, Director of Public Works Tim Hall, Ronnie Racicky, Jessica Weishaar, Mark Gruetzmacher and Randy Miller. Arriving later, Deputy Jeff Jones. The meeting was called to order by Mayor Hall with the Pledge of Allegiance following.
AGENDA
Motion by Graham second by Richter to approve the agenda after removing item number 5 under New Business as that had been taken care of at the last meeting. Aye: all. Nay: none. Motion carried.

The aerator for the lagoon has been ordered and should be here in a couple weeks.
Chip sealing has been completed.
The fire hydrants will be flushed in the next couple of weeks, when this is done residents may have discolored water. The community notification system will be used to inform residents of when this will be done.
LAW ENFORCEMENT
Deputy Jones presented the monthly report. He also wants to let everyone know that if you park on A Ave. and your vehicle is not angled in the direction of travel he has the option to cite you for obstructing traffic.

PROPERTY DEVELOPMENT
Randy Miller presented the most recent plat of the proposed development to the Mayor and Council.
A quick check list of the Subdivision Ordinance requirements was given to Mr. Miller.
He plans to get input from the New Underwood Fire Department on placement of fire hydrants in the proposed development.
Covenants for the development are being considered.
Mr. Miller will install all signs in the development.

A RESOLUTION AUTHORIZING THE EXECUTION OF CONTRACTUAL DOCUMENTS WITH THE STATE OF SOUTH DAKOTA FOR THE RECIEPT OF CORONAVIRUS LOCAL FISCAL RELIEF FUNDS
WHEREAS, The Secretary of the Treasury (Treasury) has issued a final rule to implement the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund established under the American Rescue Plan Act. Effective date: May 17, 2021.
WHEREAS, the City of New Underwood acknowledges that in order to provide financial assistance to municipalities in South Dakota, the State of South Dakota, will allocate Coronavirus Local Fiscal Recovery Funds on a statewide basis to reimburse municipalities as delineated herein; and
WHEREAS, the City of New Underwood seeks funding to make necessary investments in water and/or sewer infrastructure, and
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of New Underwood that the Mayor and Finance Officer of New Underwood may execute any and all documents as required by the State in order to receive Coronavirus Local Fiscal Relief Funds.

BUILDING PERMITS
Motion by K. Trullinger second by Hockenbary to approve Building Permit #21-23 for Pat Langfeldt at 306 S. Madison Ave. for 2 egress windows on the north side of the home. Aye: all. Nay: none. Motion carried.
Motion by K. Trullinger second by Richter to approve Building Permit #21-22 for Economic Development to move a governors’ home and garage onto the lot at 521 Cecilia Lane. Aye: Hockenbary, Richter and K. Trullinger. Abstain: Graham. Nay: none. Motion carried.
ORDINANCES
Motion by Richter second by K. Trullinger to approve the first reading of Ordinance #21-06, Article II – General - Section XIV, an Ordinance creating licensing provisions for cannabis establishments, with the cost of the license being $5,000.00 and refund of $2,500.00 if the registration certificate is not approved by the SD Dept. of Health, a limit of 1 (one) dispensary in city limits, the renewal fee being the same as the initial fee ($5,000.00) and the hours of operation being 8 a.m. to 9 p.m. Aye: all. Nay: none. Motion carried.
It was discussed that although language barriers have not been a problem in the past, the CLFR Funds require that this possibility be addressed. Motion by Hockenbary second by K. Trullinger to approve the first reading of Ordinance #21-07 - Article VIII - Section V, an ordinance ensuring language assistance for those who are Limited English Proficient. Aye: all. Nay: none. Motion carried.
STREET CLOSURE
The Council was asked to consider allowing the closure of Janklow Ave. at 100 Janklow right off of Hwy 1416 on October 7, 2021 from 6:30 p.m. to 9:30 p.m. for the New Underwood Fire Department to practice with the higher-powered fire hydrant at this residence. Motion by K. Trullinger second by Richter to allow the street closure for that date, place and time. Aye: all. Nay: none. Motion carried.
OTHER ITEMS DISCUSSED:
The first Council meeting in October will be October 12, 2021 at 6 p.m. as discussed at the August 3, 2021 meeting as the SDML Conference is being held the first week of October in Spearfish SD. Councilor Graham will not be attending the conference this year.
Mark Gruetzmacher inquired what the requirements would be for someone that would purchase the Printz Trailer Park. The Ordinance states that individual meters are required at each residence, all homes must have peaked roofs, fire-retardant siding and be a minimum size of 14’ x 70’. He was also told that if a written time line of bringing the park up to code was given to the Council, they could approve a variance for the 30-day time limit required by Ordinance.
Ronnie Racicky thanked the City for the use of the city property for the Labor Day Celebration. He also thanked the Public Works staff for cleaning the area for the Labor Day events and the Community Center cleaner for a job well done. The parade and celebration events were a success.
The Mayor and Council expressed their appreciation for all that Mr. Racicky does for the events.
The tree at 106 Madison in the alley will be removed by Public Works staff.
The audit required by Legislative Audit will be discussed at the September 21, 2021 meeting agenda.
Being no further business Mayor Hall adjourned the meeting at 7:00 p.m.

OTHER ITEMS DISCUSSED:
The first Council meeting in October will be October 12, 2021 at 6 p.m. as discussed at the August 3, 2021 meeting as the SDML Conference is being held the first week of October in Spearfish SD. Councilor Graham will not be attending the conference this year.
Mark Gruetzmacher inquired what the requirements would be for someone that would purchase the Printz Trailer Park. The Ordinance states that individual meters are required at each residence, all homes must have peaked roofs, fire-retardant siding and be a minimum size of 14’ x 70’. He was also told that if a written time line of bringing the park up to code was given to the Council, they could approve a variance for the 30-day time limit required by Ordinance.
Ronnie Racicky thanked the City for the use of the city property for the Labor Day Celebration. He also thanked the Public Works staff for cleaning the area for the Labor Day events and the Community Center cleaner for a job well done. The parade and celebration events were a success.
The Mayor and Council expressed their appreciation for all that Mr. Racicky does for the events.
The tree at 106 Madison in the alley will be removed by Public Works staff.
The audit required by Legislative Audit will be discussed at the September 21, 2021 meeting agenda.
Being no further business Mayor Hall adjourned the meeting at 7:00 p.m.
