Minutes May 21, 2014




A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on May 21, 2014.  Present were: Mayor Jack Trullinger, Council member’s: Rikka Buchtel, Larry Graham, Laurie Holloway, and Kathy Trullinger. Also present: Finance Officer Meri Jo Anderson, Dir. of Public Works John Bale, Chad Tussing, Kim Winegar, Jessica Schauer, Dee Ayers, and Dianne Trullinger.  The meeting was called to order by Mayor Trullinger.



Motion by Buchtel second by K.Trullinger to approve the agenda.  Aye: all. Motion carried.



Moved by K. Trullinger second by Holloway to approve the May 7, 2014 minutes as presented.  Aye: all.  Motion carried. 



  • Culverts at new building for Pace Apiary.

  • Jim McKee curb stop found, and getting fixed, and the location is in the books now.

  • Distributor getting fixed.

  • Pressure washing old paint off Sami Jo Pool continues.

  • Garbage truck is working fine now.



    The pool will not open until June 10th due to the new paint job being applied, and conflicts with the workers schedule.



    The Mayor has the application for the removal of underground storage tanks. If anyone has any tanks they need removed, please contact the Mayor.



    A signed complaint was received from an individual who also had a picture of the dog getting into their garbage. The Mayor reported the city will try to capture this dog. The Mayor also reiterated that the public get pictures of dogs running at large, so owners can be ticketed.



    Motion by Graham second by Trullinger that the city fill and smooth out the land on the Swanson property where the water main was placed, after the harvest in July. Aye: all. Motion carried.








    Signs at the corner of 1416 and “A” Ave saying a.k.a. Main Street and one saying Business District with an arrow pointing south, and a sign when you enter the city from the north on 1416 saying Business District with an arrow pointing west are estimated to cost $150.00. The Council agreed to go ahead and order these signs, cost share with Ec. Development discussed.



    Motion by Buchtel second by Graham to write a letter of support on the establishment of the regional rail authority, and the use of this tool for economic development along the rail line for private industry by using the funds available through the state at low interest rates. Aye: all. Motion carried.



    Ordinance Number 14-04 received its first reading. This amendment takes out the ban on certain breeds of dogs to comply with state law, and prohibits “Jake” brakes within the city limits. Motion by Buchtel second by Holloway to accept the first reading of Ordinance Number 14-04. Aye: all. Motion carried.

*Harry’s Hideaway; 16092 Hwy 1416 Lots 2BR of Lot 2 AR Vieths Subdivision Sec. 30; T2NR11E BHM;  retail on-off sale malt beverage & SD Farm Wine

No violations were issued in the last year, so no hearing was necessary. No objections were received it was moved by Graham second by Buchtel to approve the renewal of these licenses the 2014-2015 licensing period.  Aye: all. Motion carried.



BP#14-10; Brown & Dee Ayers; 113 S. “B” Ave; rebuild garage

Much discussion followed with Dee Ayers answering questions.  It was moved by Holloway second by K. Trullinger that this permit is not required.  Aye: all.  Motion carried.

BP#14-11; BJ’s; 16098 Hwy 1416; Garage door & concrete.

Motion by Buchtel second by Graham to approve this permit.  Aye: all.  Motion carried.

*Mr. Rod English will be taking down the chain link fence at 16068 Hwy. 1416 and removing the vehicles and cleaning up the property. The Mayor will contact him on the time frame he will need.

*Moved by Holloway second by Buchtel that Mr. Travis Madsen can put his fertilizer bins, to advertise and sell, by the interstate if properly anchored. Aye: all.  Motion carried.



Kim Winegar and Chad Tussing addressed the Council about the purpose and duties of the community center committee.  The Mayor will appoint the committee at the next meeting.  A letter will be sent outlining their purpose and duties.

Other items discussed:

1. The finance officer presented the written monthly governmental funds reports.

2. Deputy McPherson reported DARE and Freshman Impact have been completed. 

3. Citizen complaint on a neighbor for drunkenness and disorderly conduct.

4. Park is sterilized and dirt work should begin next week.

5. Waiting on recommendations from the Community Center Committee for a chair person.


Being no further business Mayor Trullinger adjourned the meeting at 7:30 p.m.
