MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held at 6:00 p.m. at the Community Center on November 16, 2021. Present were: Mayor Teresa Hall, Councilmembers: Larry Graham, Tera Hockenbary, Tara Richter and Kathy Trullinger. Also present: Meri Jo Anderson, Finance Director, Kristi Pritzkau, Finance Officer, Director of Public Works, Tim Hall, Caleb Dustman and Joe Weishaar. The meeting was called to order by Mayor Hall with the Pledge of Allegiance following.
AGENDA
Motion by Richter second by Hockenbary to approve the agenda with the addition of Supplemental Budget Ordinance #21-11. Aye: all. Nay: none. Motion carried.
MINUTES
Motion by K. Trullinger second by Graham to approve the November 2, 2021 regular meeting minutes with two corrections. On the bill list General Fund: Amsterdam $151.12 was paid by Mastercard. Also, addition of: Motion by Graham secondby Hockenbary to transfer $30,000 from the General Fund to the Sewer Fund to cover necessary expenditures. Aye: all. Nay: none. Motion carried.
PUBLIC WORKS
They have completed sewer jetting and flushing hydrants and some issues found are being taken care of.
Mr. Hall thanked the New Underwood Volunteer Fire Department for the use of the fire truck and Amy Caringi and Dalton Winegar for their help with the hydrant flushing.
MAYOR
The large tree in front of the Community Center will be decorated on November 27th, 2021. There will be a tree lighting celebration with games following inside on November 28th, 2021 after the Craft Fair. Hazel Phillips, who is the renter, didn’t feel this would interfere with the Fair and the Council agreed that this event will be a benefit to the community so they do not believe that it would be necessary to charge a separate fee for the use of the Community Center.
Thank you to the Viewfield Wranglers for putting food donation boxes around town. The food donated will be taken to the food pantry at City Hall.
Mayor Hall wrote a letter to the T-Mobile Hometown Grant Program for the Roping Club and the Rodeo Grounds acknowledging how beneficial they are to our community.
Thank you to Diane Tines for the donation to the Food Pantry for hygiene items and to Ellen Clifford for the food donated, these donations are much appreciated.
Cheryl Chapman with the West River Water Development District plans to attend the December 21st, 2021 Council meeting to discuss what is in the works.
Mayor Hall will inform the Council of when the District’s water summit will be held at the School of Mines.
The New Underwood Foundation meeting on November 14th, 2021 was very informative. The Foundation is run through the South Dakota Community Foundation (SDCF). More information can be found at info@sdcommunityfoundation.org. It is a very good opportunity for the community and will benefit many different non-profit organizations in the area.
There is a Black Hill Area Mayor’s Meeting scheduled for December 8, 2021 at the Community Center in New Underwood. These meetings are very informative about issues happening in our area and on a national level, depending on who is able to attend.

ORDINANCE #21-09
AN ORDINANCE AMENDING SECTION XIV OF THE REVISED ORDINANCES OF THE CITY OF NEW UNDERWOOD CREATING LICENSING PROVISIONS FOR CANNABIS ESTABLISHMENTS

04: LICENSE APPLICATION
(a) An application for a cannabis establishment license must be made on a form provided by the city. No other application form will be considered.
(b) The applicant must submit the following:
The name, address, and birth date of each employee, principal officer, owner, and board member of the proposed cannabis establishment.
A sworn statement that no employee, principal officer, owner, or board member has been convicted of a violent felony offense in the previous ten (10) years in any jurisdiction.
05: ISSUANCE OF LICENSE
(a) The city will issue a license unless:
Any employee, owner(s), principal officer, or board member of the applicant is under the age of twenty-one (21) years; or
Any employee, owner, principal officer, or board member of the applicant has been convicted of a violent felony offense in the previous ten (10) years in any jurisdiction;
10: REVOCATION
A license may be revoked if the license is suspended under Section 10 and the cause for the suspension is not remedied.
(b) A license may be revoked if the license is subject to suspension under Section 10 because of a violation outlined in that section and the license has been previously suspended in the preceding 24 months.
(c) A license is subject to revocation if a license holder or employee of a license holder:
A license holder, or an owner, principal officers, or board member thereof, has been convicted of, or continues to employ an employee who has been convicted of, a disqualifying felony offense as defined by SDCL 34-20G;

RURAL SERVICE DISTRICT
A discussion was had concerning removal of the developing properties in New Underwood city limits from the Rural Service District. Meri Jo Anderson stated she will get some guidance from the Pennington County Auditor on how to do this properly.
SPECIAL LICENSE
Motion by Graham second by K. Trullinger to approve Special License #21-18 for Moe’s Bar and Grill on December 11, 2021 at the Community Center for the Roping Club NFR watch party. Aye: all. Nay: none. Motion carried.
SDPAA CONTRACT
Motion by Hockenbary second by Richter to approve the Mayor’s signature on the SDPAA contract endorsements. Aye: all. Nay: none. Motion carried.

Motion by K. Trullinger seconded by Hockenbary to approve the first reading of the Supplemental Budget Ordinance #21-11. Aye: all. Nay: none. Motion carried.
OTHER ITEMS DISCUSSED:
Governmental fund sheets were presented.
The development planned for on the west end of town is going to have streets that will be chip sealed when they are brought up to City code. It is not a required by City Ordinance for streets to have curb and gutter.
Casey Peterson and Associates, Ltd. plans to meet with City staff on November 29th, 2021 at City Hall to review the audit process and plans to begin the 2020 audit December 14th, 2021.
Being no further business Mayor Hall adjourned the meeting at 6:34 p.m.
