MINUTES OF THE
NEW UNDERWOOD CITY COUNCIL
A regular meeting of the New Underwood City Council was held on July 21, 2004 at 6:00 p.m. Present were: Mayor Benita White, Councilmembers: Jackie Dahlquist, Michael Green, Tyler Richter and LeeAnn Schumacher. Also present: The Fin. Officer Meri Jo Anderson, Dir. of Pub. Works Greg Hall, Asst. Finance Officer Teresa Gossard, Officer Adrian, John Torrey, Don Knecht, Mary Ann Trople, Al Ackerman, Wes Flint, Nessa Green, Karina Wolken, LaVonne & Robert Moffitt, John & Anita Szymonski, and Sharon Anderson. Arriving later: Rhonda Torrey, Dave Dietrich, Les Jeffords.
PUBLIC HEARING
The hearing on the placement of a mobile home on a single lot was called to order. BP#04-27; Don Knecht; 405 E. Pine. Being no one presented themselves to voice any objections to this permit the hearing adjourned at 6:05 p.m. with the regular meeting being called to order immediately following.
AGENDA
Motion by Richter second by Green to approve the amended agenda. Aye: all. Motion carried.
MINUTES
Motion by Richter second by Schumacher to approve the July 7, 2004 minutes. Aye: all. Motion carried.
FINANCIAL STATEMENTS
The governmental funds sheets to date were presented to the Council. The budget hearing will be set for some time in August to go over the budget by line item with the Council.
DONATION
A letter from Governor Rounds inviting the Council to the Korean War Memorial and requesting contributions. Moved by Dahlquist second by Richter to send a $100.00 contribution for this cause. Roll call vote. Aye: Dahlquist, Green, Richter, Schumacher. Nay: none. Motion carried.
AKER DEVELOPMENT
The Mayor reported on the Planning Commission meeting she and the Finance Officer attended last week. The Aker Development wanted to rezone and put in 148 new home sites to the west of New Underwood. The County turned down the rezoning request for this development.
COMMUNITY CENTER
Mr. Simmons replaced sections of plywood on the south roof. He recommended the Council consider what to do about ventilation for the roof, since none was ever installed. Motion by Schumacher second by Richter to purchase ventilated ridgecap to correct this problem. Aye: all. Motion carried.
Les Jeffords gave the Council a written estimate on seamless gutter for the Community Center. Motion by Richter second by Dahlquist to issue a contract for Mr. Jeffords for the seamless gutter. Aye: all. Motion carried.
Discussion on removal of the rocks and the box out front followed. The Council agreed for now the rocks should be taken out and get a bid for the cement.
Prices will be obtained on a Marquee in front of the center so citizens know what events are going on.
The Swamp Coolers have been removed from the roof and inside with ceiling tiles being replaced. Four portable swamp coolers were purchased to replace the old swamp coolers as approved by the City Council via phone.
LAW ENFORCEMENT
Officer Adrian answered questions from the audience about patrol hours, vandalism, having our own police department verses contracting with the County. He felt communication is the key and there are never enough police officers to cover all the small problems that arise here.
BUILDING PERMITS
#04-20; Best Little Store House; 300 S. "A" Ave.; Addition and variance on set backs to the west.
04-27; Don Knecht; 405 E. Pine; move on mobile home.
Motion by Green second by Schumacher to approve permit number 04-27, since citizen input was favorable at the hearing. Aye: all. Motion carried.
Councilman Green removed himself from the Council during discussion on permit 04-20. Vanessa Green showed pictures that showed this building would not be an obstruction. Discussion on what the actual central business district is, since in the central business district you can build right on the property line.
Motion by Schumacher second by Richter to approve the variance on set backs on BP#04-20 and also to approve this permit. Aye: Dahlquist, Richter, and Schumacher. Abstain: Green. Motion carried.
The Council will take a look at this ordinance and make the wording for Commercial property set backs more definitive and more in line with their vision for the future.
AMBULANCE CHIEF RESIGNATION
A letter of resignation was received from Mary Stetson from her position as ambulance chief. The Mayor and Council thanked her for her eight years of service to the Community.

ARTICLE II SECTION III
AN ORDINANCE AMENDING ARTICLE II SECTION III ON APPOINTED OFFICERS AND EMPLOYEES
BE IT ORDAINED by the Common Council of the City of New Underwood that Ordinance Number 86-1 be amended to read as follows:
1. Officers.
The officers of the City shall be an attorney, public works director, finance officer, chief of police (if not Pennington County Sheriff Contract), and such other officers as may be necessary for the administration of city business and affairs. Such officers shall be hired by the mayor and common council and shall hold office until their successors are duly hired and qualified.
2. Oath of Officer.
Each officer and such other officers as may be required shall take an oath of office before entering upon the discharge of duties. The oath of office shall be taken annually thereafter at the first meeting in May. The oath shall be subscribed by the person taking it and shall be filed and preserved in the office of the finance officer.
3. Removal of officials.
The mayor shall have the power to remove any official whenever he shall be of the opinion that the interest of the city demands a removal. The mayor shall report the reasons for such removal to the common council at a regular or special meeting to be held not less than five (5) nor more than fifteen (15) days after such removal. If the mayor shall fail or refuse to file with the finance officer a statement of the reason for the removal or if the council by two-thirds vote of all its members as authorized by law, disapproves the removal, the official shall thereupon become restored to said office. No official shall be removed a second time for the same incident.

BE IT ORDAINED by the New Underwood City Council that the following amounts be appropriated to the 2004 budget to cover costs: 602/432.5/426 - $4,300.00 - Means of finance: undesignated funds from sewer monies - $4,300.00; 101/413/411 - $146.25 - Means of finance: Reimbursement from School $146.25; 101/414/414.60 - $1,700.00 - means of finance: reimbursement from Amb. Dept.; 601/433.4/426 - $7,500.00 - means of finance: cost share & water revenues.

Motion by Schumacher second by Green to approve spiking permit 04-09. Aye: all. Motion carried.
PROPOSED GIMPEL PLAT
The Council had some questions for Mr. Gimpel, but since he did not attend no decisions could be made on the proposed plat.
MOSQUITO TRAPPING
The Dir. of Public Works reported the most mosquitoes he has trapped in an evening is five and he wanted the public to be aware that there are gnats that look like mosquitoes.
OTHER ITEMS DISCUSSED
- Radiological samples are being taken on the old well.
- The Council went over the master street plan.
- Two citizens would like the dumpsters moved away from their houses due to the unpleasant odor. Orange deodorizer will be used.
- A letter to a business owner will be sent advising him that the garbage is still blowing out of his trash receptacles.
Being no further business, the Mayor adjourned the meeting at 8:00 p.m.
