Minutes July 5, 2017
A regular meeting of the New Underwood City Council was held at 6:00 p.m. at the Community Center on July 5, 2017. Present were: Mayor Jack Trullinger, Councilmembers: Teresa Gossard, Larry Graham, Karin Shoemaker, and Kathy Trullinger. Also present: Meri Jo Anderson, Finance officer, Kristi Pritzkau, Assistant Finance officer, Dir. of Public Works Tim Hall, Deputy Jeff Jones, Marvin Rask, and Dianne Trullinger. The meeting was called to order by Mayor Trullinger.

MANHOLE RISERS
Mr. Hall would like to purchase 12 manhole risers, since the chip seal has built up around those manholes. Motion by Shoemaker second by Gossard to approve up to $1,250.00 to purchase manhole risers. Aye: all. Motion carried.
GARBAGE TRUCK TIRES
Mr. Hall requested monies to purchase 8 new tires for the garbage truck, which was budgeted for. Moved by Shoemaker second by Gossard to approve this request for up to $4,000.00 expenditure. Aye: all. Motion carried.
EXERCISE WATER VALVES
Rural water has a program that includes cleaning out all the water valves on the mains and freeing them all up, so they can all be turned on and off, and not froze up. Mr. Hall explained the cost of this program is $600.00. Motion by Graham second by Shoemaker to grant this request and hire Rural Water to exercise the water valves, since it has not been done in decades.
LAW ENFORCEMENT
Deputy Jeff Jones presented the written monthly report. The fireworks went well in New Underwood with citizens being considerate for their neighbors for the most part. He took care of an issue with kids throwing mail out of mailboxes and another issue of children running through other residence yards.
AQUATIC DIRECTOR
A fund raiser for the pool, to do major repairs, will be held July 26 at the Sami Jo Pool with food and swimming and then a movie in the park afterwards. Everyone is encouraged to stop by and enjoy themselves.
Melanie Tish is getting budget figures ready and will get them to the Finance Officer.
MAYOR
Moes will have a band Sunday night outside Moes Bar and Grill. Motion by K. Trullinger second by Gossard to set the time limit for the band music playing outside to ten p.m. that night, so as not to disturb the neighbors. Aye: all. Motion carried.
The Mayor will be out of town the 19th through the 27th, so Councilor Gossard will be Acting Mayor.
Mayor Trullinger also reported he had received concerns from two citizens who felt fireworks should be banned due to the dry conditions on the 4th of July this year.
PARK MONIES
Councilor Shoemaker requested the park discussion be tabled until she can get with the school board to see what direction they are going with the tennis courts. The Council agreed that the parks monies would be put back on the agenda when she has more information.
ORDINANCE NUMBER 17-05
BE IT ORDAINED by the Common Council of the City of New Underwood, Pennington County, South Dakota that the following specified sections of Article VII Section A. are hereby amended as follows: (***Note: underlines are additions)
17. Weeds. No owner or occupant shall allow any weeds or plants to grow that are declared to be dangerous or noxious weeds by the South Dakota Department of Agriculture or the State Weed Commission. Grass and weeds that are non-noxious shall not be allowed to grow to a height of more than eight (8) inches or which have gone or are about to go to seed. Fallen tree limbs, dead trees, and dead tree limbs which constitute a health, safety or fire hazard are declared a nuisance. This section does not prohibit the cultivation of crops or vegetation grown in a livestock pasture, wildflower display garden or undeveloped, unpopulated area.
The Director of Public Works, may at the beginning of or during the growing season, by public notice, require all weeds and tall grass on such lot to be cut and removed. Notice need not be given personally, but may be given generally by one publication in the official newspaper. Such notice shall provide that each owner, occupant or person in charge of any lot within the city shall cut and remove all noxious weeds, and keep grass and other weeds cut from alley to street even in the right of waysas to prevent aforementioned problems from occurring. Failure to keep such weeds and grass cut will cause the same to be cut and assess the costs thereof against the property benefited. One such notice shall be sufficient for each growing season.

A letter will be sent to a citizen on Janklow Ave who needs a building permit.
Being no further business Mayor Trullinger adjourned the meeting at 6:37 p.m.
