MINUTES OF THE

NEW UNDERWOOD CITY COUNCIL

A regular meeting of the New Underwood City Council was held on July 21, 2005 at 6:00 p.m. Present was Mayor Benita White, Councilmembers: Jackie Dahlquist. Michael Green, and LeeAnn Schumacher. Absent: Tyler Richter. Also present: Dir. Public Works Greg Hall, Asst. Finance Officer Teresa Gossard, Officer Wardle, Lt. Kurt Weber, Al Ackerman, Ernie Boyd, and George Langendorfer.

AGENDA

Moved by Schumacher second by Green to approve the agenda. Aye: all. Motion carried.

MINUTES

Motion by Schumacher second by Green to approve the July 6, 2005 minutes. Aye: all. Motion carried.

LAW ENFORCEMENT

Officer Wardle introduced the new Commander of the Patrol Division, Lt. Kurt Weber.

DRAINAGE ON WEST END OF BOX ELDER STREET

DPW Greg Hall reported that Cetec Engineering had been down and took shots to determine what needed to be done to correct the drainage problem. City Hall has not gotten a report back on that yet. Discussion followed on attempting to save or possibly transplant some of the trees that the drainage correction might affect.

ADDRESS CHANGES

A representative from 911 came to City Hall and went over the address map with the Mayor and Finance Officer. It was reiterated that the reason the changes are being made is to alleviate the confusion for Emergency Personnel. It will affect people with physical addresses of Box Elder Street, Adams Avenue, and Orin Avenue. The Mayor showed the council the preliminary map. It will not be finalized until all proper authorities have been contacted, ie utility companies, emergency services, etc.

SALES TAX ORDINANCE

ORDINANCE NUMBER 05-04

ARTICLE II SECTION II

AN ORDINANCE TO AMEND ARTICLE II: GENERAL; SECTION II: SALES TAX.

BE IT ORDAINED by the Common Council for the City of New Underwood that Article II; Section II; sales tax, to take effect Jan. 1st, 2006, be amended to read as follows:

 

Delete all of the following:

Section 2. Tax will not apply to items specifically exempt under SDCL 10-52-2.6. Items exempted from city tax under SDCL 10-52-2.6 include: farm machinery and irrigation equipment, parts and repairs for farm machinery, agricultural animal health products and medicines, and intrastate trucking and garbage hauling (industry 4212 and 4214 of the Standard Industrial Classification Manual).

Moved by Schumacher second by Green to accept the second reading of Ordinance Number 05-04. Roll call vote. Aye: Schumacher, Green, Dahlquist. Nay: none. Motion carried.

DOGS

The first reading of Ordinance 05-02 was tabled. Lt. Weber and Deputy Wardle gave valuable input on the wording of this ordinance, which deals with Livestock and Domestic animals within City limits. The council will look over Pennington County’s Ordinance and see how it can be adapted to fit the City of New Underwood.

ANNEXATION PETITION

Mayor Benita White stepped down at this time and Council President Dahlquist presided over this portion of the meeting. White presented a petition for annexation to the Council, whereupon Resolution 05-02 was introduced.

RESOLUTION NUMBER 05-02

 

WHEREAS as an incorporated municipality, the City of New Underwood, may expand its borders by resolution of the governing body as applied in SDCL 9-4-1, and

WHEREAS the owners of a parcel of land contiguous to the City of New Underwood described as Being 1.15 acre of land, more or less, particularly described as the Balance of Tract A in the North One-Half (N1/2) of Section 31, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota have requested the above mentioned parcel of land be annexed to the corporate limits of New Underwood, and

NOW THEREFORE BE IT RESOLVED that the Council of the City of New Underwood, Pennington County, South Dakota having received and duly approved a petition for annexation from Benita R. White, owner, do hereby formally approve the annexation of the Balance of Tract A in the North One-Half (N1/2) of Section 31, Township 2 North, Range 11 East of the Black Hills Meridian, New Underwood, Pennington County, South Dakota.

BE IT FURTHER RESOLVED that the New Underwood City Council having acted in compliance with SDCL 9-4-1 does hereby instruct the Finance Officer to file copies of this resolution with the Pennington County Auditor and the Register of Deeds and Pennington County Planning and Zoning Commission for their information, records, and comments.

Motion by Schumacher second by Green to authorize the Council President’s signature on the petition for annexation. Aye all, motion carried.

Motion by Schumacher second by Dahlquist to pass Resolution 05-02. Roll Call Vote.

Aye: Schumacher, Green, and Dahlquist. Nay: none. Motion carried.

DUMP KEY

A citizen expressed displeasure at the new dump key policy. In order to check out a dump key, you must now leave your driver’s license or $20.00, which will be returned to you when you return the key. This was put into place because the key wasn’t always being returned. The Council explained to the citizen that it had to be regulated, as a single piece of domestic garbage will result in a $10,000.00 fine in our restricted use site.

OTHER ITEMS DISCUSSED THROUGHOUT MEETING

  1. Public Works Department is patching and getting ready to chip seal streets.
  2. Budget hearing set for August 17th at 5:00 PM.
  3. Speeding on Highway 14-16/Box Elder Road.

Being no further business the Mayor adjourned the meeting at 8:00 p.m.
