A. TRAFFIC CONTROL – GENERAL

The injury of any person or the property of any person while violating any provisions of the City Ordinance regulating vehicular traffic shall be presumptive evidence of careless/reckless driving, and be sufficient proof to sustain conviction.

No person shall operate a vehicle within the corporate limits of New Underwood unless such vehicle is equipped with good and positive brakes at all times, such as will enable the driver thereof to come to a full stop within a reasonable distance when necessary.

The driver of any vehicle shall give right-of-way at an intersection to any vehicle coming from his right within such a distance and at such a speed that the two vehicles would reasonably meet on such intersection.

It shall be the duty of the driver of every vehicle to keep to the right of the center of any street, alley, avenue or roadway within the corporation limits of New Underwood, when such is possible, and any driver of a vehicle causing accident by reason of non-compliance with the section shall be subject to arrest for careless/reckless driving.

At any time when deemed advisable, or for emergency purposes, a fire or police officer may stop, block, direct or re-route traffic and it shall be the duty of every driver of a vehicle to obey such officer. Emergency vehicles shall be given the right-of-way at all time.

B. EXHIBITION DRIVING

            Any person who drives a vehicle within the limits of the City of New Underwood in such a manner that creates or causes unnecessary engine noise or tire squeal, skid, or slide upon acceleration of stopping; or that simulates a temporary race; or that causes the vehicle to unnecessarily turn abruptly or sway shall be guilty of Exhibition Driving.

C. SPEED LIMITS

Thirty-five (35) miles per hour on 14/16

Twenty-five (25) miles per hour on Main Street

Twenty (20) miles per hour upon any other street within the City limits, unless otherwise posted

Fifteen (15) miles per hour in all school zones: Monroe Avenue from three hundred (300) feet North of the Monroe/Ash intersection to the Monroe/Oak intersection; Madison Avenue from 14/16 to intersection of Madison/Oak; Oak Street from the Madison/Oak intersection to the Monroe/Oak intersection; Ash Street from Janklow Avenue to three hundred (300) feet West of the Ash/Bailey intersection; Linn Street from Madison Avenue to Baily Avenue; Bailey Avenue from Linn Street to the intersection of Bailey/Oak.

D. STOP SIGNS

Except when directed to proceed by a police officer or traffic control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall come to a full stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection. After having stopped, the driver shall yield the right-of-way to any vehicle which has entered or is approaching the intersection from another roadway  and shall not proceed into the intersection until certain that such intersecting roadway is free from oncoming traffic which may affect safe passage.

The driver of a vehicle emerging from an alley, building, private road or driveway within a business or residential district shall stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across such alley building entrance, road or driveway, or in the event there is no sidewalk area, shall stop at the point nearest the street to be entered where the driver has a view of approaching traffic thereon.

E. SNOWMOBILES

As per SDCL 32-20A-7 Conditions permitting operation on roadways unauthorized operation as misdemeanor. A snowmobile may be operated upon or across a roadway:

1. To cross at right angles to the roadway only after stopping and yielding the right-of-way to all approaching traffic and crossing as closely as possible to an intersection or approach.

2. When there is no ditch along either side of a roadway, then on the shoulder or berm until there is a ditch on the right-hand side of the roadway which can be traversed.

3. When by reason of a bridge or culvert or other obstruction, it is impossible to proceed, then only in the right lane of the roadway and for only such distance as necessary to clear the obstruction;

4. When permitted in writing by a law enforcement officer or a county civil defense director as authorized under SDCL 32-20A-8;

5. When snow has not been removed from a roadway which has been obstructed and is not used by other types of motor vehicle.

6. Snowmobiles must follow all the laws that apply to the operation of a motor vehicle.

F. Golf Carts

The term golf cart means a four wheeled vehicle originally and specifically designed and intended to transport one or more individuals and golf clubs for the purpose of playing the game of golf on a golf course.

The City of New Underwood hereby permits the use of golf carts on the municipal streets of the City of New Underwood, subject to the following:

1. The golf cart is to be insured;
2. The person operating the golf cart shall hold a valid driver’s license;
3. The person operating the golf cart shall obtain a permit from the City of New Underwood to operate the golf cart on municipal streets; the fee for said permit shall be $25.00.
4. The golf cart shall be required to display a slow-moving vehicle emblem in accordance with SDCL 32-15-20 or a white or amber warning light in accordance with SDCL 32-17-46

No person may operate a golf cart on a state or county highway except for crossing from one side of the highway to the other. A golf cart may cross the highway at a right angle, but only after stopping and yielding the right-of-way to all approaching traffic and crossing as closely as possible to an intersection or approach.

G. SNOW AND ICE CONTROL POLICY

It is the policy of the City of New Underwood to initiate snow removal operations to maintain traffic as long as visibility is above minimum and weather conditions are such that plowing can be done safely and effectively.

The Director of Public Works has the responsibility of initiating all snow removal actions using their best judgment and considering all prevailing weather conditions, amount of snow fall, and type of snow fall. The Mayor will also decide when/where to commence operations in emergency or extreme conditions.

The general practice will be as follows: When snow fall is at least two (2) inches, all roads and sidewalks in priority route schedule will be followed.  At this time plowing or sanding may commence before, during, and after normal working hours as well as weekends and holidays.  Deviations will occur.  For example, storm severity may preclude all snow removal operations or seriously impede response or an emergency may require a different allocation of resources.

1. Sidewalks in Central Business District

2. “A” Ave and parking areas in Central Business District and Fire Hall concrete

3. Ash Street from “A” Avenue east to the school, then all of Madison Street to Hwy 1416, and the L; being Bailey Street and Linn Street, west and north of the school.

4. Parking lots at the school: east, west and south side

5. Oak Street east from “A” Avenue to Monroe Street

6. All other streets by efficiency routes as determined (someone has to be last)

NOTE: Sanding and plowing of any streets may be stopped at any time to go back to higher priority streets to re-sand or plow, if conditions warrant.

If immediate need for Police, Fire and Rescue assistance, City personnel will leave the public right-of-way to respond. Snow removal crews will provide necessary assistance such as opening a driveway or parking lot to give access to the emergency crews.  Isolated problem areas where traction is urgently needed before all other areas are handled.

Conditions may warrant the application of sand or salt or a mixture thereof. Materials will be applied on “A” Avenue, Ash Street past the school and that portion of Madison Avenue compromising the L, and hills on “B” Avenue and south “C” Avenue.

City snow plows will not clear private driveways or private property, such as parking lot, except in an emergency as previously discussed. Snow placed in a driveway or on sidewalks where the driveway or sidewalk meets the street by City plows is the responsibility of the property owner to remove.

To the extent that any previous rule, regulation, policy or past practice, written or unwritten, is in conflict with the provision of this policy, such is hereby withdrawn, voided, and all personnel should conduct themselves in conformity with this policy.

This policy is not intended to create any duty to any individual member of the public or to protect any particular or circumscribed class of persons. All or parts of this policy may be affected by at least one or more of the following which will delay all or some of the services provided.

1. Equipment breakdown

2. Vehicle disabled in deep snow

3. Weather so severe as to cause crews to be called in from the streets

4. Equipment rendered inadequate by the depth of the snow or drifts

5. Crew breaks, and breaks requiring for refueling, refilling of material spreaders and installing chains and new blades

6. Unforeseen conditions and emergencies
