A regular meeting of the New Underwood City Council was held at 7:00 p.m. at the Community Center on March 1, 2017. Present were: Mayor Jack Trullinger, Councilmembers: Teresa Gossard, Larry Graham, Karin Shoemaker, and Kathy Trullinger. Also present: Meri Jo Anderson, Finance Officer, Dir. of Public Works Tim Hall, Deputy Jones, Clerk Ione Wolf, Rod & Delores Crosbie, Shirley Printz, Steve Swanson, and Dianne Trullinger. The meeting was called to order by Mayor Trullinger.

The Finance Officer presented the 2016 annual report to the Council. Motion by Graham second by K. Trullinger to approve the 2016 annual report, publish in the legal newspaper and forward it to the state Dept. of Legislative Audit. Aye: all. Nay: none. Motion carried. (See below)
Deputy Jones presented the written monthly report.
Roxy Thompson requested a donation for the post prom. Motion by K. Trullinger second by Gossard to approve a donation of $100.00 for the post prom. Aye: all. Motion carried.
MEETING DATE CHANGE
Motion by Gossard second by Schumacher to change the first meeting in April to Tuesday April 4, 2016 at 7:00, since the SDML district meeting is on April 5, 2016.
MOBILE HOME ORDINANCES
The Mayor requested that the discussion be narrowed to mobile homes coming into mobile home parks, and fine tuning the current ordinance on what restrictions and guidelines they will need. Discussion followed with input from the audience. The comments covered: Year restrictions, physically inspecting all mobile homes prior to permit approval, leaving pictures required in the ordinance, but request all four sides, need to be cognizant of increasing and tax base by improving the appearance of the City, minimum of 14 feet wide, and adopting a check list that would need to be met: no bare wood, skirting comprised of same material all way around, undamaged roof & siding, entry condition, all doors & windows intact and working. Two of the Council will prepare the check list and present at the next meeting.
AMENDMENT TO NUISANCE ORDINANCE
The proposed amendment to Nuisance Ordinance Article VII Section A. was presented by Councilor Graham. (*Note: underlines are additions, strikethroughs are deletions)
18. Notice of Violation. Whenever an authorized representative of the City finds that a nuisance exists within the City, the representative can either have the nuisance abated immediately or have the City send a notice of violation to the person creating, permitting, or maintaining such nuisance. Note: Within Mobile Home Parks, the mobile home park owner (Owner of the Mobile Home Court) will also receive the abatement notice and any violations and fines that the tenant receives will also apply to the mobile home park owner, who will pay the fines plus any costs and attorney’s fees against the property, if they do not pay the accumulated costs, it will be added to their property taxes by special assessment.
Discussion on the pros and cons followed with the council agreeing they will have the first reading of this ordinance at the next meeting.

The Mayor had inspected the mobile homes today and recommended disapproving this permit due to the condition of the siding (wood rot). Motion by Gossard second by K. Trullinger to deny this permit. Aye: all. Motion carried.

Moved by K. Trullinger second by Graham to approve this permit. Aye: all. Motion carried.
Motion by K. Trullinger second by Gossard to go into executive session at 8:05 p.m. as per SDCL 1-25-2 (3) Communication with attorney. Aye: all. Motion carried.
The Mayor adjourned the executive session at 8:55 p.m. and reconvened to regular session.

Resolution Number 17-04 was introduced.
RESOLUTION NUMBER 17-04
WHEREAS the New Underwood City Council recognizes the need to continue to expand the tax base of the City by productive and constructive means,
WHEREAS the New Underwood City Council already passed resolution number 16-05 authorizing the purchase price of $30,000.00, and
NOW THEREFORE BE IT RESOLVED that Mayor Jack W. Trullinger is hereby authorized to execute any and all documents necessary on behalf of the City of New Underwood to purchase the land and buildings located at 513,515,517 S. “A” Avenue New Underwood, South Dakota, and more particularly described as follows:
Lots 7, 8, 9, & 10 Block 5 Original Town of New Underwood Section 31 in Township 2 North of Range 11 East of the Black Hills Meridian in the City of New Underwood, Pennington County, South Dakota.
