A regular meeting of the New Underwood City Council was held on June 1, 2005 at 6:00 p.m. Present were: Mayor Benita White, Councilmembers: Jackie Dahlquist, Michael Green, Tyler Richter, and LeeAnn Schumacher. Also present: The Fin. Officer Meri Jo Anderson, Dir. Public Works Greg Hall, Officers Wardle & Morgan, Francis Peterson, John Torrey, Christi Hendrickson, Carol Jensen, Sherry Richter, and Al Ackerman.

MALT BEVERAGE HEARING

A hearing for a retail (on-off sale) Malt Beverage licenses for Steve’s General Store was held at 6:00 p.m. Officer Wardle expressed concerns about the need for a designated area being roped off within this lot for the sale & drinking of alcohol. Concerns were expressed about individuals under 18 selling beer to customers. The Mayor adjourned the hearing at 6:10 p.m. and called the regular meeting to order.

RECREATION AREA

The swimming pool opened Saturday, but due to the cold weather it has been slow.The Katy Johnson Memorial monies will extend the roof to the concession stand instead of installing an awning. The estimated cost is $2,700.00, of which the memorial monies is short $700.00. The Swimming Pool Committee is having a garage door installed in the concession area that opens to the pool to aid in security and to keep the debris from blowing in.Councilman Dahlquist got a playset for the park donated. This is a great addition to the play area. The playset will be placed to the south of the pool. A 6 ft. high privacy fence will be installed on the south side and run east to west with the estimated cost being $600.00.Moved by Richter second by Schumacher that the City use park monies to pay the $700.00 shortfall on the roof extension and approve the fence purchase. Aye: all. Motion carried.Closing the alley instead of vacating the alley was discussed. The Dir. of Public Works expressed concerns about the utilities that run along this alley especially the main trunk that runs to the south. Letters will be sent to adjacent land owners to receive their input on closing the alley in the recreation area.

LAW ENFORCEMENT

Officer Wardle introduced his trainee – Brian Morgan.Signs painted with NUC now painted NUB, still under investigation.Water tower painted 2005.Athletic Complex vandalism.

KINDERGARTEN CELEBRATION

The Mayor reported the annual kindergarten celebration went well. Officer Wardle and Mayor White gave out congratulation certificates and deputy stars. Thanks to the Community Center Committee for all their work.

NUISANCE ABATEMENTS

A vacant house on “B” Ave. is becoming a health and safety nuisance, since the windows and doors are broke out, weeds overgrown, and old freezers on lot. The City Attorney advised the Council to send a letter to the last known address giving them ten days to abate this nuisance since it poises a health, safety, and welfare issue. Motion by Schumacher second by Green to authorize the Mayor to send this letter. Aye: all. Motion carried.Francis Peterson wanted to know the wording on the Nuisance Ordinance in order to alleviate a problem he is having with a neighbor. He expressed concerns about vehicles, West Nile, snakes, skunks, porcupines, coyotes, ect. According to the nuisance ordinance and policy, if we receive a signed complaint we will act on it.

MALT BEVERAGE LICENSE

Steve’s General Store; 510 E. Box Elder; Lots 1 & 2 AR Vieths Subdivision SE ¼ SE ¼ T2NR11E BHM; retail on-off sale Malt Beverage.More discussion on the designated area and state law followed. Motion by Schumacher second by Green to table this malt beverage license to the June 15 meeting until more information is obtained from the Dept. of Revenue. Aye: all. Motion carried.

DRAINAGE PROBLEM

The drainage problem on the west end of W. Box Elder Street was again brought to the Council’s attention. The Dir. of Public Works recommended this problem be turned over to the City Engineer. The Council instructed him to contact Mr. Wierenga and report back with possible solutions and costs.

OPEN CONTAINER

The NU Alumini Association requested that open container be allowed on July 2 on Main Street from Oak to Elm. The citizen who has the community center rented the 2nd did not have a problem with this. Motion by Richter second by Schumacher to grant this request providing that Main Street is roped off at each end, so there is no vehicular traffic. Aye: all. Motion carried.

WEST NILE

The Post will do an article on West Nile and prevention. Citizens are encouraged to treat their own yards with insecticides for control and prevention and avoid letting stagnate water stand in tires, dog dishes, rain gutters, bird baths, ect.

ADDRESS CHANGES

The Mayor will be sending out letter to some of the residents for changing their addresses. 911 is having some problems finding a few of our addresses the way they are currently set up.

SERVICE LINE BREAK

Mr. Torrey requested the City pay part of the repair to his water service line since it took 2-3 hours to find a working shut off and he feels the garbage truck caused the problem. He questioned why the city replaced curb stops to one particular property, when this is part of the service line. The Dir. of Public Works reported that in the last two years the City has replaced approximately twenty curb stops with metal ones at the City expense, since it is in the City’s best interest to have metal ones that are in working order. Much discussion followed about the ordinance stating that the property owner is responsible for service lines and the City is responsible for the main that feeds these service lines. The Council tabled this until the next meeting when Mr. Torrey can bring back an itemized bill for time, machine cost, and parts information. In the meantime the dumpster will be moved back.

OTHER ITEMS DISCUSSED THROUGHOUT MEETING

1. Elected Officials Workshop July 15 in Pierre.
2. Letter from Golden West with cable increase.
3. City Hall renovation, no word yet.
4. Get estimate on cost of rewording the nuisance ordinance from the City attorney.

Being no further business the Mayor adjourned the meeting at 7:50 p.m.
