MINUTES OF THE

NEW UNDERWOOD CITY COUNCIL

  

A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on April 25, 2012.  Present were: Mayor Jack Trullinger, Council member’s: Rikka Buchtel, Laurie Holloway, Sheila White, and Joe Whitney. Also present: Finance Officer Meri Jo Anderson, Cris, Keira, and Sydnie Allen, Jim  & Kathy Harbert, Dianne Trullinger, and Rory Pisher.  The meeting was called to order by Mayor Trullinger.

 

PUBLIC HEARING

A public hearing was held at 6:00 p.m. to receive citizen input on Ordinance Number 12-05; Establishing Rural Service District and Ordinance Number 12-06: Amending zoning map.  The Mayor explained the area that was involved in this service district.  No one voiced any objections to these ordinances.  The Mayor closed the hearing at 6:05 p.m.

 

AGENDA

Motion by Buchtel second by Holloway to approve the amended agenda.  Aye: all. Motion carried.

 

MINUTES 

Moved by Whitney second by White to approve the April 4th minutes with the following correction: west water main is to 160th Ave. not 159th St., and approve the April 18, 2012 minutes as presented.  Aye: all.  Motion carried. 

 

COMMUNITY CENTER

The concrete pad in front of the Community Center is being replaced next week, so the back door and the south doors will have to be used as the main access to the building.

 

STORAGE OF EZ STREET

The EZ street cold mix will be arriving soon for the street patching to begin.  The Council agreed that it can be stored on the cement pad to the north of the public works shop this year, but would like to get a better storage location put in the budget next year.

 

DOT

The Mayor, Dir. Of Public Works, and Finance Officer met with DOT on future projects with streets and recreational paths in the New Underwood area.  The Mayor again reiterated to them the dangers of bicyclist on old highway 1416, and the need for a path.

 

KINDERGARTEN CELEBRATION

Invitations have been sent for the kindergarten celebration to be held on May 9, 2012 at 6:30 p.m.

 

SAFE WATER AWARD

DENR announced that the City of New Underwood public water system and the system’s certified operators have been awarded a Certificate of Achievement for outstanding water system operations and providing safe water to the public. Mayor Trullinger presented Mr. Bale his award.  

 

ABATEMENTS OF NUISANCES

A signed citizen complaint was received on dormant vehicles located at 200 E. Pine, 204-212 S. “A” Ave, and 16068 Hwy. 1416. The Mayor reported the citizen at 200 E. Pine is putting tarps on his cars, and had been given an extra 20 days.  The property at 204-212 S. “A” has a fence around it, that was placed there by the City in exchange for the floodway easement agreement on his property in 1983.  The Council did not feel they could change an agreement that was made with this same property owner by another Council, especially since it involved a trade for land use. A building permit for a fence is on the current agenda for the property at 16068 Hwy. 1416.  

Letters sent to abate:

Skirting – This will be turned over to the attorney.

Fence – A privacy fence is being installed.

Removing dormant vehicles & securing mobile home – The mobile home park owner has taken legal action against this property owner.

Barking Dog – this dog will be removed from the city.

 

PARK

Councilor Buchtel reported that the park committee is still working on grants.  Tyler Richter is removing park equipment from the base and has offered to donate some of this equipment to the city; pictures of this park equipment were presented to the council.  Motion by Holloway second by Whitney to pursue getting this equipment.  Aye: all.  Motion carried.

 

ORDINANCES #12-05 AND #12-06

Motion by Buchtel second by Holloway to table the second reading of ordinance number 12-05; establishing a rural service district until the May 2 meeting.  Aye: all.  Motion carried.

Moved by Buchtel second by Holloway to table the second reading of ordinance number 12-06; zoning this district until the May 2 meeting.  Aye: all.  Motion carried.

 

ORDINANCE NUMBER 12-07

Ordinance number 12-07, amending the planning and zoning ordinance to add a section that deals with rural service districts.  Motion by Buchtel second by Whitney to approve the first reading of ordinance number 12-07.  Aye: all.  Motion carried.  The attorney will be present at the next meeting to discuss this ordinance with the council.

 

SOUTH WATER MAIN

The boring will be done this week to extend the south water main.  The Mayor explained directional boring.  The easement for this line has been signed and filed.

 

ORDINANCE NUMBER 12-08

Supplemental Budget Ordinance Number 12-08 received its first reading.  Motion by Holloway second by White to approve the first reading of ordinance number 12-08.  Aye: all.  Motion carried.

 

 

 

 

 

HOME OCCUPATION

Motion by Buchtel second by Whitney to approve this home occupation.  Aye: all.  Motion carried.

 

           

SPIKING PERMITS

SP#12-05; Betsy Knuppe;  May 26, 2012

SP#12-06;  Sheila White; April 27, 2012

Motion by Whitney second by Holloway to approve these spiking permit.  Aye: Buchtel, Holloway, Whitney.  Abstain:  White.  Motion carried.

 

BUILDING PERMITS

BP#12-05; Jennifer Sargent; 112 N. “C” Ave; fence

BP#12-06; Rod English; 16068 Hwy 1416; fence

BP#12-07; NU Roping Club; 201 N. “A” Ave.; remove bleachers

Moved by Whitney second by White to approve permit #12-05,6,7.  Discussion on these permits followed with good public participation.  Questions from the public centered on allowing a junk yard on a main street.  The Council agreed they would need to get advice from the City attorney at the next meeting on how to deal with types of businesses.  On the motion the vote was called.  Aye: all.  Motion carried.

 

Other items discussed:

  1. Governmental      funds sheets presented to the Council.
  2. Pet      Clinic April 29; 1-3; public works shop.
  3. Clean      up week-end April 21-22, well attended and was very orderly.
  4. Mayor      reported on District 9 Edgemont meeting April 18, 2012.
  5. Rocks,      concrete and fort removed from the park.
  6. A      lagoon stabilization class was attended by Mr. Bale & Mr. Beesley in      Pierre and they received their certification.
  7. The      dog trapping has turned into more of a cat trapping.
  8. The      Mayor will contact the county or get a price for a solar flashing light at      the corner of 1416 and 161st.

 

 

Being no further business Mayor Trullinger adjourned the meeting at 7:30 p.m.
