MINUTES OF THE

NEW UNDERWOOD CITY COUNCIL

 

A regular meeting of the New Underwood City Council was held at 6:00 p.m. in the Community Center on December 17, 2008.  Present were: Mayor Benita R. White, Councilmember’s: Tyler Richter, John Torrey, and Jack Trullinger; Absent: Michael Green. Also present:  Fin. Officer Meri Jo Anderson, Dir. Public Works Greg Hall, Deputy McPherson, Diane Trullinger, George Langendorfer, Cris & Keira Allen, and another deputy.    

 

PUBLIC HEARING

A public hearing was held to transfer the 2009 on/off sale liquor licenses of RK’s to 415 S. “A” Ave; Lots 5-7 Blk 2; Org. twn. No one presented themselves to object to this location change.

 

AGENDA

Moved by Torrey second by Richter to approve the amended agenda.  Aye: all. Motion carried.

 

MINUTES                                                               

Moved by Torrey second by Trullinger to approve the December 3, 2008 minutes as presented with the following correction:  Electric under water should say $650.17, instead of $1,088.97.  Aye:  all.  Motion carried.

 

CHECK

Motion by Trullinger second by Richter to approve a replacement check for check number 17688, which was written September 3, but never cashed.  Aye:  all.  Motion carried.

 

CHAIN OF COMMAND

The Mayor explained the chain of command for City Employees.  The Mayor is in charge of the department heads and does their evaluations, and the department heads are in charge of their staff and they do their evaluations.  She encouraged the Council to come to her if there are complaints from the employees so they can be remedied.

 

LIQUOR LICENSE

Since no one voiced any objections during the public hearing it was moved by Torrey second by Richter to transfer the 2009 on/off sale liquor licenses of RK’s to 415 S. “A” Ave; Lots 5-7 Blk 2; Org. twn.; as requested by Randy & Kathy Madsen.  Aye: all.  Motion carried.

 

NUISANCE ORDINANCE

Nuisance Ordinance #08-06 received its second reading.  Motion by Trullinger second by Richter to approve the second reading of Ordinance Number 08-06.  Aye:  Richter and Trullinger.  Nay:  Torrey.   Motion did not pass, since it was not approved by a majority of the Council. 

  

ORDINANCE ON BUILDING PERMIT FORM

Ordinance Number 08-07 received its second reading.

AN ORDINANCE TO AMEND ARTICLE IV; PLANNING & ZONING; CNU FORM #1; FIRST PAGE of BUILDING PERMIT

 

BE IT ORDAINED by the Common Council for the City of New Underwood that Article IV; Planning & Zoning; CNU Form; The following sentences be added to the First Page of Building Permit and read as follows:

 

If survey markers are not available, then you build at your own risk on actual set backs.

All new construction must supply a copy of their plumbing & electrical inspection or permit #’s.

After a lengthy discussion on what was really being accomplished with these changes it was moved by Trullinger second by Torrey to approve Ordinance Number 08-07.  Roll call vote.  Aye:  Richter, Torrey, and Trullinger.  Nay: none.  Motion carried.

City officials will look at the sites prior to construction, and these permits must be signed by the City Official prior to these permits going to the Council.

 

This ordinance put some changes into the building permit form.  Motion by Trullinger second by Green to approve the first reading of ordinance number 08-07.  Aye: all.  Motion carried.

 

WATER, SEWER, AND GARBAGE FEE INCREASES

Discussion on the need for increases in the Enterprise funds followed with good public participation.  The water has not raised since 1998, sewer since 1983, and garbage since 1992, and they have been working at a deficit the last three years.  The Council all agreed this is not an easy task, but it is a necessary one.  The Mayor and Finance Officer will draft the ordinance for the next meeting with the input and figures the Council suggested.

  

RESOLUTION NUMBER 08-10

Resolution 08-10 was introduced.

WHEREAS, Section 114 of the Fair and Accurate Credit Act of 2003 (16 C.F.R. #681.2) requires all municipalities that operate utilities to develop an Identity Theft Prevention Program in compliance with FACTO, and

 

NOW THEREFORE BE IT RESOLVED THAT the City of New Underwood hereby appoints the Mayor as Program Administrator, with authority to develop, get Council approval, and implement an Identity Theft Prevention Program.

Motion by Trullinger second by Torrey to approve resolution number 08-10.  Roll call vote.  Aye:  Richter, Torrey, and Trullinger.  Nay:  none.  Motion carried.

 

ELECTION BOARD AND COMBINED ELECTION

Moved by Richter second by Trullinger that Connie Carmichael, Donna Rankin, and Kay McKee be appointed as the 2009 election board and that the City & School combine their elections to be held on April 14th.  Aye: all.  Motion carried.

 

KNUPPE PROCLAMATION

PROCLAMATION

 

WHEREAS the City of New Underwood acknowledges William (Bill) Knuppe’s long life as a citizen of New Underwood, and

 

WHEREAS William (Bill) Knuppe will be 105 years of age on Sunday December 21, and

 

NOW THEREFORE BE IT RESOLVED that I, Benita R. White, Mayor of the City of New Underwood, do hereby declare December 21, 2008 as WILLIAM KNUPPE DAY in New Underwood in honor of the long life of a valuable citizen.  We would encourage all residents of this community to call, write, or in any way they feel appropriate to pay homage to this fine gentleman.

Motion by Trullinger second by Torrey to approve this proclamation.  Aye: all.  Motion carried.

 

 

OTHER ITEMS DISCUSSED:

  1. The Finance Officer reported on the SD Municipal League Executive Board meeting last week, since she is a member of this Board.  She went over the legislation that the league is pursuing this next legislative session.
  2. The City plows the snow in front of the Fire Hall, when time allows.
  3. The office in the public works shop is almost framed.
  4. Dinner with the Legislators is February 8, 2009.
  5. The pilot study on Rads is completed.  Should be getting a report back from WRT January.
  6. Dean Hackens has fixed the leaks on the public works shop.
  7. The Mayor & Council commended the State and Governor for closing down the interstate on Saturday night. 
  8. The year in review was prepared by the Finance Officer and presented to the Council.

 

Being no further business the Mayor adjourned the meeting at 8:30 p.m.
